1. About us

This website is operated by CDS Brands Pty Ltd, trading as Rugged Up ("Rugged Up", "we", "us" or "our"). By using this website or buying from us, you agree to these terms, so please read them carefully. If you don't agree, please don't use the site.

2. Using our website

You agree to use this website only for lawful purposes and not to interfere with how it works. We may update, change or take down any part of the site at any time without notice.

3. Our products

We do our best to describe and photograph our products accurately. Colours can look slightly different depending on your screen, so the product you receive may vary a little from what you see online.

The Original is made from polyester and is not fire resistant. Keep it away from open flames, embers, campfires and heaters.

4. Prices and payment

All prices are in Australian dollars and include GST where applicable. We may change prices at any time, but changes won't affect orders already placed.

If an item is listed at the wrong price, we'll contact you before your order ships. You can choose to go ahead at the correct price or cancel for a full refund.

Payments are processed securely by our payment providers. If you pay with a buy-now-pay-later service such as Afterpay, that provider's own terms also apply.

5. Orders

Placing an order is an offer to buy. We accept it when we dispatch your order. We may refuse or cancel an order, for example if stock runs out, the price is wrong, or we suspect fraud or resale. If we cancel an order after you've paid, we'll refund you in full.

6. Discounts and promotions

Pack and bulk discounts apply automatically at checkout based on the number of items in your cart. Only one automatic discount applies per order, and you'll always get the one that saves you the most. Discount codes can't be combined unless we say so. We may change or end any promotion at any time, but this won't affect orders already placed.

7. Shipping and returns

Our Shipping policy and Refund policy form part of these terms.

8. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.

9. Limitation of liability

To the extent permitted by law, and subject to your rights under the Australian Consumer Law, we are not liable for any indirect or consequential loss arising from your use of our website or products. Where our liability can't be excluded but can be limited, it is limited to replacing the goods, supplying equivalent goods, or paying the cost of doing either.

10. Intellectual property

Everything on this website, including the Rugged Up name, logo, photos, designs and text, belongs to us or our licensors. You may not copy or use it without our written permission.

11. Reviews, photos and content you share

If you send us a review, photo or other content, or tag us on social media, you give us permission to use it on our website, social channels and marketing, with credit to you where practical. Please only share content you own, and nothing offensive or misleading.

Our website may link to or use third-party services, such as payment providers, carriers and apps. We aren't responsible for their content or practices, and their own terms apply.

13. Privacy

How we collect and handle your personal information is set out in our Privacy policy.

14. Changes to these terms

We may update these terms from time to time. The version on this page when you place an order is the one that applies to that order.

15. Governing law

These terms are governed by the laws of Queensland, Australia. You and we submit to the jurisdiction of the courts of Queensland.
